General Terms and Conditions of Vehicle Storage

These General Terms and Conditions of Vehicle Storage (hereinafter “GTVS”) govern all vehicle storage services provided by the company International Trade Company (hereinafter “ITC”) at its agency located at Réunion Roland Garros Airport for its Clients (hereinafter referred to as “Client” or “Clients”).

ARTICLE 1 : GENERAL PROVISIONS

Any vehicle drop-off with ITC is subject to acceptance of these GTVS.

Vehicle storage is offered online through the website (hereinafter “the Site”), which is owned and managed by ITC.

ITC provides vehicle storage services to both individuals and professionals (hereinafter “the Client” or “Clients”) under the conditions defined below.

Storage of oversized vehicles (wider and/or longer than a 4x4 pickup) is possible, but it is subject to prior approval from ITC. Motorcycles, trailers, motorhomes, and right-hand drive vehicles are not accepted. For vehicle storage requests from a company, ITC can only accept the request after the company has provided an official document from the business owner or someone authorized to bind the company for storage purposes. This person must present a valid ID and a document confirming the authorization from the business owner.

For vehicle storage for an individual other than the owner: The vehicle owner may delegate an agent to drop off and/or pick up the vehicle, and the agent must provide a signed power of attorney from the owner and identify themselves with a valid ID. If these conditions are not met, ITC reserves the right to refuse storage or the return of the vehicle.

ARTICLE 2 : ONLINE RESERVATION PROCEDURE FOR STORAGE

To store a vehicle with ITC, the Client fills out the designated form on the Site, providing the following information:

  • Vehicle drop-off date

  • Vehicle pickup date

  • First and last name

  • Email address

  • Vehicle registration number

Before clicking the “Reserve” button at the indicated price at the end of the form, the Client must first accept these GTVS by checking the box provided for this purpose.The Client is then redirected to a payment page to complete the order by credit card, following the instructions on the site.

ARTICLE 3 : CONTRACTUAL DOCUMENTS AND PRECONDITIONS

The vehicle storage contract (hereinafter “the Contract”) takes effect when ITC physically receives the vehicle after:

  • The Client has signed the Contract upon drop-off;

  • An inspection and equipment checklist of the vehicle to be stored has been completed by the Client upon arrival, signed by both parties. ITC reserves the right to refuse storage if the vehicle inspection cannot be properly completed (e.g., if shocks, scratches, or damage are hidden by dirt). The Client also commits to leaving the vehicle in perfect operational and safety condition;

  • The original vehicle registration card, valid insurance certificate, and vehicle keys are presented.

ARTICLE 4 : SERVICE DETAILS AND PROCEDURES

4.1 Vehicle Drop-off and Pickup :

Vehicle drop-offs are done daily during the agency's opening hours, Monday to Sunday between 8 AM and 5 PM. On the day of the drop-off, the Client will go to the rental parking lot next to Roland Garros Airport in Saint-Denis, in the area reserved for ITC.

If the drop-off occurs outside these hours, the Client should leave the vehicle in the previously designated parking space, place the vehicle papers in the glove compartment, and leave the keys in the ITC mailbox located at the exit of the rental parking lot. Since the arrival inspection cannot be conducted in the presence of both parties, it will be done by the agent upon arrival, with no possibility of dispute.

Throughout the duration of the Contract, ITC commits to storing the vehicle exclusively in a secured and monitored parking lot.The Client authorizes ITC to move the vehicle within the parking lot at any time due to operational or security needs.The Client must ensure the vehicle alarm is deactivated and/or provide the vehicle's ignition code.ITC commits to using the stored vehicle only when necessary for its transfer between the airport and the storage area located 100m from the airport or in cases of force majeure requiring the vehicle's movement for safety reasons.The Client commits to leaving the vehicle in perfect operational and safety condition.In the event of a breakdown of the stored vehicle, repairs will be the responsibility of the Client. If the vehicle cannot start, the Client will be taken back to the storage parking lot and must have the vehicle repaired immediately, within a maximum of 24 hours.

4.2 Vehicle Pickup :

The vehicle must be picked up by the Client at the end of the Contract period.

The vehicle will only be returned to the Client who signed the Contract or to their duly authorized representative, provided they show proof of identity.

The person picking up the vehicle must sign the release form provided in the Contract, and any reservations must be clearly noted.

Upon the Client's return, a joint inspection will be carried out, resulting in the creation of a vehicle condition and equipment checklist, signed by both parties. If the Client returns the vehicle outside business hours, a photo system will be implemented, with the Client responsible for the photos.

Any disputes or claims regarding the vehicle's condition will only be considered if made before leaving the rental parking lot at Roland Garros Airport. The vehicle pickup marks the end of the Contract.

ARTICLE 5 : RIGHT OF WITHDRAWAL

In accordance with Article L. 221-28 al.1 of the Consumer Code, ITC Clients booking a vehicle storage service online do not have the right of withdrawal provided in Article L. 221-18 of the Consumer Code.

ARTICLE 6 : PRICING AND PAYMENT

6.1 Storage Fees :

Storage fees are payable in advance for the entire contractual period, according to the rate in effect on the day the vehicle is stored. The minimum billing duration is 24 hours.Accepted payment methods: Credit card, Visa, Mastercard, American Express.Prices and VAT rates are subject to change without prior notice.

6.2 Conditions for Advance Payment or Prepayment :

Considering the full prepayment of the Contract made on the Site, the following provisions apply:

  • For cancellations made at least five days before the scheduled start date of the Contract, the Client will receive a full refund.

  • For cancellations made less than 5 days before the scheduled vehicle drop-off date, the Client will be charged a cancellation fee of €50.

ARTICLE 7 : DURATION OF THE STORAGE CONTRACT

The Contract is concluded for the duration specified when the vehicle is dropped off and detailed in the Contract.If the Contract is extended beyond the initially planned date or if the vehicle is withdrawn early, the Client must notify ITC during opening hours, otherwise, they will not be assisted upon return.

ARTICLE 8 : AMENDMENT OF THE GENERAL VEHICLE STORAGE TERMS

The GTVS applicable are those in effect on the date they are accepted by the Client, as defined in Article 1.However, ITC may modify these terms at any time without prior notice, provided that the Client is informed of such changes upon their entry into effect by email and/or by publication on the Site.ITC will update the GTVS by indicating the date of the last update at the top right of the document.

ARTICLE 9 : INSURANCE AND LIABILITY

ITC has subscribed to an insurance policy to cover its liability in connection with its vehicle storage activity during the entire storage period and for the vehicle transfer.ITC cannot be held responsible for any deterioration, alteration, or damage to the stored vehicle if the cause predates the vehicle’s storage or if it results from force majeure, a defect inherent to the vehicle, or natural wear and tear.ITC is not liable for any damages caused by the sun, water (except for the contracted storage option), weather conditions, or the normal wear and tear of materials, as the vehicles are parked outdoors. ITC is also not responsible for mechanical, bodywork, upholstery, equipment, and accessory damage resulting from the vehicle's general condition or due to prolonged immobility, or for any items of any kind, personal belongings, and accessories left inside the vehicle.ITC disclaims any liability for indirect damages suffered by its Clients, including financial or commercial harm, loss of revenue, profit, data, orders, or customers.

ARTICLE 10 : FORCE MAJEURE

In the event of a force majeure occurrence as defined by Article 1218 of the Civil Code, including but not limited to unpredictable events such as strikes, work stoppages, social unrest, factory closures, floods, fires, production or transport failures not attributable to ITC, supply shortages, wars, riots, insurrections, and more generally any circumstance or event preventing ITC from properly fulfilling its obligations, ITC will not be held responsible for any failure to execute its obligations under these terms, provided that ITC informs the Client immediately and takes all necessary measures to limit the effects.If the effects of a force majeure event last beyond the initially agreed-upon storage period, the Client may terminate the Contract by registered letter with acknowledgment of receipt and obtain a refund for the rental they could not use or a credit voucher.

ARTICLE 12 : DATA PRIVACY

The data concerning the Client, requested during the booking of vehicle storage, is mandatory; failure to provide this information will prevent the conclusion of the storage contract. These data are processed by ITC, the data controller, and are used for managing the business relationship (storage contract, billing, management of fines and claims, managing Client accounts, satisfaction surveys, reviews on products/services, etc.). ITC also uses the Client’s contact details to send them similar products to those ordered. The Client has the right to object to each communication.In accordance with the applicable regulations, the Client can access their data or request its deletion. The Client also has the right to object, rectify, limit the processing of their data, request the portability of their data, and define directives regarding the fate of their personal data after death. For more information on how ITC manages Client data or to exercise their rights, the Client is invited to consult the Privacy Policy available at the reception, in-store, or on the rental company’s website at www.tropicar.fr or upon request at dpo@gbh.fr.

ARTICLE 13 : MEDIATION

In case of a dispute, the Client should first contact ITC’s Customer Service to resolve it amicably. If this approach fails, the Client may use the online mediation service provided by CMAP (Center for Mediation and Arbitration of Paris) at the URL: http://www.cmap.fr/ or by post at:CMAP (Consumer Mediation Service) – 39 Avenue Franklin D. Roosevelt – 75008 Paris.To be admissible, the mediation request must include: your postal, email, and phone details, as well as the full name and address of our company, a brief summary of the facts, and proof of prior efforts made.In accordance with the mediation rules, it is reminded that a consumer dispute must first be addressed in writing to ITC's Customer Service before making a mediation request to CMAP.

ARTICLE 14: APPLICABLE LAW AND COMPETENT JURISDICTION

The GTVS are governed by French law.Any dispute related to these terms will be brought before the jurisdiction territorially competent under the Civil Procedure Code.The Client has the option to submit any dispute related to these terms either before the jurisdiction of the place where the consumer resided when the Contract was concluded or before the jurisdiction where the damaging event occurred.In any case, the Client is duly informed that they are entitled to resort to mediation under the provisions of Article L. 612-1 of the Consumer Code and Article 13 of these terms.

ITC selects its domicile at Roland Garros Airport, 97438 Sainte Marie.
